• Refund Form: A form that must be completed by the Client to request a refund.

These Terms apply to all users globally and retroactively govern transactions made before the Effective Date.

3. User Obligations

1. Provide accurate and complete information when creating an account or placing an order.
2. Comply with all applicable laws and regulations.
3. Use the purchased Digital Assets only as permitted under these Terms.
4. Refrain from engaging in prohibited activities, including but not limited to:
   • Reselling or redistributing Digital Assets.
   • Using Digital Assets for unlawful purposes.
   • Attempting to disrupt or interfere with XOR’s website or operations.

4. Intellectual Property Rights

• All Digital Assets remain the intellectual property of XOR or its licensors.
• By purchasing Digital Assets, you are granted a limited, non-exclusive, non-transferable license to use them for personal or commercial purposes, subject to these restrictions:
  • Prohibited Uses: Redistribution, sublicensing, reselling, or claiming ownership of Digital Assets.
  • Enforcement: Unauthorized use may result in termination of your license and legal action.

5. Payment and Refund Policy

• Payments must be made in full at the time of purchase.
• Refunds are only available under the following conditions:
  1. A completed Refund Form is submitted within [14 days] of purchase according to our Refund policy.
  2. The Digital Asset has not been downloaded or accessed.
  3. A valid reason for the refund request is provided.
• Refund requests are reviewed at XOR’s sole discretion.

6. Limitation of Liability

To the fullest extent permitted by law:

• XOR disclaims all warranties, express or implied, regarding the quality, performance, or compatibility of Digital Assets.
• XOR shall not be liable for:
  • Indirect, incidental, or consequential damages.
  • Losses arising from the use or inability to use Digital Assets.
• Total liability is limited to the purchase price of the Digital Asset.

7. Data Protection

• XOR complies with the UK General Data Protection Regulation (UK GDPR).
• Personal data collected during transactions will be processed in accordance with our Privacy policy.
• Clients have the right to access, rectify, or request deletion of their data by contacting us at info@webgraphicsmall.com. 

8. Dispute Resolution

1. Governing Law: These Terms are governed by the laws of England and Wales.
2. Mediation and Arbitration: Disputes shall first be resolved through mediation or arbitration in accordance with UK law.
3. Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction over unresolved disputes.
